HERE'S WHY YOU NEED ACCESS

Data protection rules are about to become a really big deal to any business operating in Europe, British or otherwise. People are a lot more aware of the value of their information and the problems that arise if it is lost, stolen or misused.

The European Union has imposed complicated rules designed to address this. On 25th of May 2018 the European General Data Protection Regulation (“GDPR”) will come into force and will be immediately

effective under UK law.

You need to know how to navigate the rules successfully if you are to manage the risk of fines amounting of up to 2-4% of worldwide annual turnover and/or €10-€20 million.  Any serious breach would likely be investigated by the ICO & could take up significant time and resource to resolve. Further there is a risk of civil action from those affected by the data breach.

You need to work out if your company is caught; and if so, examine the implications of compliance and the risk associated with non-compliance before taking appropriate measures to protect your organisation.

We offer pre-audit briefs for directors and newly appointed data protection compliance officers.

We supply briefing documents and aide memoirs which go through the existing legal rules and all the prospective changes. We include diagrams which show how each rule applies within the business cycle.

  • We help you recognise data flows within your organisation.
  • We help you understand how to perform an audit and produce questionnaires.
  • We provide an audit report template.
  • We help you go through a checklist of common remedial actions.
  • We help you prepare for ongoing compliance and monitoring.
  • We provide action plans for data protection subject access requests.
  • We provide action plans for data breaches whilst minimising exposure to complaints and fines.

The law expects you to train all members of staff on how to comply with the new rules.

We work with you to take the findings of your audit report and create bespoke training to ensure that:

  •  employees know what they should and should not do; and when to tell a manager about things;
  • managers know how to ensure compliance in their departments, how to discipline on this issue and how to keep records;
  • compliance officers and others know how to respond to data protection subject access requests and deal with data breaches.

WHEN SHOULD YOU TAKE ACTION?

Right away.

  • You will need to manage the risk of being unable to audit, assess, recruit, train and change the culture in time.

  • It will take time to train a new Data Protection Officer.

  • Thereafter the audit process alone could take months; and further time will be spent implementing the recommendations, which are likely to cover all aspects of the business.
  • Take the opportunity to ensure that ‘privacy by design’ is integral to I.T. operations now to save rectification costs later.

  • Avoid the risk of accidental acceptance of detrimental Terms & Conditions proposed by clients and suppliers before 2018 through lack of awareness.

  • Get staff used to the new responsibilities and obligations in good time.

  • Trial your intended route forward before the regulations take effect and fines could be imposed.

We would love to hear from you.
